Vendors must complete a Top of the Hill Vendor Application, and must have a N.Y.S. Tax ID, and carry a $1,000,000.00 General Liability Insurance policy listing "Top of the Hill Flea & Farmer Market" as an "additional insured" and must be able to provide proof of all applicable Certificate(s) and/or License(s). Whether a NYS or out-of-state Vendor.

Vendors selling baked goods or dairy items must provide proof of Sanitary Inspection from the Department of Agriculture & Markets.

Vendors selling food for consumption should have a current Health Permit and may be required to provide additional certificates, as appropriate, depending upon the cooking method.

Vendors selling flowers or plants must have a valid Nursery Certificate.

All Occasional Sales are required to sign a "Hold-Harmless Agreement"

OCCASIONAL SALES ARE USUALLY PEOPLE WHO ARE NOT REQUIRED TO HOLD A SELLER PERMIT BECAUSE THEY WILL NOT BE MAKING A SERIES OF QUALIFIYING SALES. FOR EXAMPLE, A PERSON WHO CLEARED THEIR GARAGE OF USED ITEMS ACCUMULATED FOR THEIR OWN PURPOSES WHO SELL ONLY THOSE ITEMS WOULD QUALIFY AS AN OCCASIONAL SELLER PROVIDED THEY DO NOT MAKE SALES ON A REGULAR BASIS

Vendors must wear proper attire at all times. Shirts and shoes must be worn.

ALCOHLIC beverages may NOT be consumed on the premises by Vendors. Anyone under the influence, or suspected of being under the influence, will be expelled immediatley with forfeiture of the market.

USE OF OBSCENE LANGUAGE OR ACTIONS OF PHYSICAL VIOLENCE ARE GROUNDS FOR IMMEDIATE EXPULSION FROM THE MARKET PREMISES WITH FORFEITURE OF THE TOTAL RENTAL FEE.

NO VENDOR WHOLESALING IS PERMITTED AT THE MARKET. VENDORS MUST CLEARLY POST THEIR POLICY FOR RETURNS, EXCHANGES AND REFUNDS SO THAT IT IS VISIBLE TO ALL CUSTOMERS.

THE FOLLOWING ITEMS ARE NOT PERMITTED TO BE SOLD AT OR BROUGHT TO THE MARKET PREMISES:

ABSOLUTLEY NO FIREARMS OR OTHER WEAPONS, AMMUNUITION, FIREWORKS, POPPING CAPS, OR DYNAMITE. ANY OFFENSIVE, ILLICIT OR PORNOGRAPHIC MATERIAL. NO ILLEGAL OR STOLEN ITEMS, ANY DRUG RELATED PARAPHERNALIA, TOBACCO PRODUCTS, OR STOLEN PROPERTY/MERCHANDISE. NO PIRATING AND/OR DUBBING OR ANY VIOLATION OF COPYRIGHT LAW. NOR ARE ANY FOOD ITEMS TO BE SOLD FOR CONSUMPTION AT THE MARKET PREMISES WITHOUT PRIOR APPROVAL OF THE MARKET MANAGEMENT AND WITHOUT PROPER LICENSING AND/OR HEALTH CERTIFICATES. VENDORS VIOLATING ANY OF THE AFOREMENTIONED MAY BE EXPELLED FROM THE PREMISES, MAY LOSE THEIR STATUS AS AN APPROVED SELLER AND IMMEDIATLEY FORFEIT THEIR TOTAL RENTAL FEE. NO PETS OR ANIMALS OF ANY KIND ARE ALLOWED IN MARKET. ALL BULLHORNS, LOUDSPEAKERS, AND CARNIVAL BARKING ARE PROHIBITED. ANY APPROVED RADIO,TELEVISIONS AND STEREOS MUST BE KEPT AT LOW VOLUME.

NO SMOKING IN THE MARKET AT ALL .

MANAGEMENT'S RIGHTS

NO RAIN CHECKS OR REFUNDS WILL BE ISSUED ALL DEALERS MUST COMPLY WITH ALL STATE AND COUNTY LICENSES REQUIREMENTS AND ALL ORDINANCES. MANAGEMENT RESERVES THE RIGHT TO REFUSE TO, OR EXPEL, ANY VENDOR WHEN DEEMED IN THE BEST INTEREST OF THE MARKET AND OF OTHER VENDORS AT MANAGEMENT'S SOLE DISCRETION.

RELEASE AND MANAGMENT DISCLAIMER: AS FURTHER CONSIDERATION FOR THE LEASE OF YOUR BOOTH SPACE TO YOU, BY SIGNING THIS DISCLAIMER, THE VENDOR, AGREES THAT YOU WILL RELEASE , DISCHARGE, IDEMNIFY AND HOLD "TOP OF THE HILL FLEA & FARMER MARKET" AND IT'S AFFILIATES HARMLESS FROM ANY LOSS, COST OR EXPENSE OF ANY SORT OR NATURE , OF ANY OCCUPANCY OR SALE OF ANY ILLEGAL OR UNLICENSED MERCHANDISE AT YOUR DESIGNATED BOOTH BY YOU, OR BY REASON OF YOUR FAILURE TO COMPLY IN ANY RESPECT WHAT-SO-EVER TO PERFORM ANY AND ALL REQUIREMENTS AND PROVISIONS OF THE RULES AND REGULATIONS AT "TOP OF THE HILL FLEA & FARMER MARKET".

PRICING AND PAYMENT

PAYMENT IS DUE IN FULL BY NO LATER THAN 9:45AM THE 1ST DAY OF THE WEEKEND OF, IF RENTING A SINGLE DAY, THE DAY BOOTH IS RENTED OR LEASED. BOUNCED CHECKS WILL BE CHARGED A MINIMUM FEE OF $45 (MAY BE GREATER IN MANAGEMENT'S SOLE DISCRETION). IF PAYMENT IN FULL IS NOT MADE WITHIN 30 DAYS OF SERVICES RENDERED, YOUR CREDIT CARD MAY BE CHARGED BUT WILL NOT BE CHARGED ANY MORE THAN THE ORIGINALLY AGREED UPON AMOUNT.
